Oxfordshire Assizes.

Thomas Gumm, charged with having on the 19th day of October last, at Fawler, maliciously stabbed Edward Pratley, with intent to do him some grievous bodily harm. - Mr. Keating was counsel for the prosecution, and Mr. Pigott appeared for the prisoner.

Edward Pratley, examined, I am a labourer residing at Finstock; on the 19th of October, was at the beer shop, at Fawler Mill; many other people were there, and amongst them the prisoner; I was there altogether about three hours and a half, and was perfectly sober; saw the prisoner with something in his hand; heard him say he would cut bloody light into somebody that night; I was in the passage; the prisoner came and struck me a blow with his left hand, and knocked my cap off; this was followed up by a blow with his right hand, and I found myself stabbed a little above the thigh; I said I was stabbed, and the prisoner ran away; I fainted, was carried home to Finstock, and was confined to bed twelve days.

Cross-examined - Had had only two pints of beer; it was Fawler Feast; there was dancing going on; danced myself; saw no fighting; there were upwards of 100 people in and near the house; know a person named Eltham; never said to him, I didn't know who stabbed me; told him it was Thomas Gumm ;never had any doubt about the person who stabbed me; saw no quarrelling at the mill.

P. Akers examined - am brother-in-law to last witness; was the Mill, at Fawler Feast, about half-past eight o'clock; saw the prisoner close to the settle; he had something in his hand like the blade of a knife. I said here's Thomas Gumm standing with a knife open in hand; he immediately ran to the passage, and I followed; when I got to the door heard some one say they had been stabbed; found it was the prosecutor; prisoner ran away; I followed him; he was overtaken and searched.

Cross-examined - heard no row at he Mill; saw no fighting; that I will swear; did not hear the prisoner make use of any expressions about stabbing.

Sidnal Smith examined - on the evening in question was at the Mill; heard Prattley say he was stabbed by Thomas Gumm; saw him stooping and putting his hand to his side; I followed the prisoner and caught him, he ran towards Charlbury.

Jonathan Paine examined - I am proprietor of Fawler Mill and Beer House; the prisoner was at my house on the evening of the Feast; served him with a cigar ; he appeared to have had a little beer, but nothing to do him any injury; when I heard of Pratley's being stabbed, I sent for a surgeon.

John Godfrey examined - I am a surgeon, residing at Charlbury; attended the prosecutor, found a wound in the left hip three quarters of an inch in diameter; he was very faint from loss of blood. A knife would inflict such a wound; it was within two inches of a very dangerous part, and had it touched that part, it would be almost sure to cause death.

Mr. Pigott made an able defence.

Verdict Guilty of stabbing, with intent to do some grievous bodily harm.- 15 years' transportation.
