WITNEY.
Our Monthly County Court was holden at the Staple Hall Inn on Tuesday the 23rd ult., before J.E. Parry, Esq. Q.C. The list contained 34 plaints, 20 of which were heard. The following case excited much interest:- David Faulkner v. William Charles Pratley.- Plaintiff sued defendant for the sum of 14l. 3s. 1d., secured by a note of hand payable on demand. The facts elicited from plaintiff proved that a running grocery account had been kept by defendant'' late father (Charles Pratley), who was many years forest-keeper to Lord Redesdale; on the balance being demanded, the son repudiated the claim, and disputed the debt in toto as unjust, although the goods were regularly entered in a pass-book; acting advisedly, plaintiff took out a summons against defendant, as administrator of the effects of his late father, who died intestate; to prevent publicity and probable mischief, plaintiff was entreated to accept an instalment, and security for remaining balance; when application was made for payment, defendant tendered a portion of the sum due.- After hearing both sides, his Honour gave judgment for plaintiff for full amount, with statute costs, to be paid in a fortnight to Mr. Faulkner, observing that the moiety offered should have been taken, and the remainder sued for.- Mr. Milward, instructed by Mr. Mantell, appeared for plaintiff, and Mr. F. Hunt for defendant. |
