Full Will: |
This is the last Will and Testament of me James Pratley of Swinderby in the County of Lincoln Farmer made and signed this thirty first day of May One thousand eight hundred and ninety nine I revoke all Wills by me at any time heretofore made I appoint Dalton Blow of Swinderby aforesaid Farmer Robert Hodgkinson of Newark upon Trent in the County of Nottingham Solicitor and also my son Walter Pratley (on his attaining the age of twenty one years) (hereinafter called "my Trustees") to be the Executors and Trustees of this my Will And I give to the said Dalton Blow the sum of five pounds for his trouble in acting as such Executor and Trustee I devise and bequeath all my real and personal estate not hereby otherwise disposed of unto my Trustees Upon trust that my Trustees shall sell call in and convert into money the some or such part thereof as shall not consist of money and shall with and out of the moneys produced by such sale calling in and conversion and with and out of my ready money pay my funeral legacies bequeathed by this my Will or any Codicil hereto And shall stand possessed of the said residuary trust moneys In trust for all my six children namely Edith Annie Priscilla Ada Walter Harry and John Sydney who being sons have attained or shall attain the age of twenty one years or being daughters have attained or shall attain that age or shall marry under that age in equal shares and if there shall be only one such child the whole to be in trust for that one child Provided always that if any child of mine shall die in my lifetime leaving a child or children who shall survive me and being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under that age then and in every such case the last mentioned child or children shall take (and if more than one equally between them) the share which his her or their parent would have taken of and in the residuary trust funds if such parent had survived me and I also declare that my Trustees may at their own discretion raise any part or parts not exceeding together one moiety or the vested or presumptive share of any child or grandchild of mine under this my Will and apply the same for his or her advancement preferment or benefit as my Trustees shall think fit and I hereby declare that my Executors or my Trustees shall not be bound in any case to act personally but shall be at full liberty to employ a Solicitor or any other agent to transact all or any business of whatsoever nature required to be done in the premises including the receipt and payment of money and shall be entitled to be allowed and be paid all charges and expenses so incurred And I further declare that any executor or trustee for the time being hereunder being a Solicitor or other person engaged in any profession or business shall be entitled to charge and be paid all usual professional or other charges for my business done by him or his firm in the premises whether in the ordinary course of his profession or business or not and although not of a nature requiring the employment of a Solicitor or other professional person In Witness whereof I have hereunto subscribed my name the day and year first before written - James Pratley - Signed by the said Testator as and for his last Will and Testament in the presence of us both present at the same time who in his presence and in the presence of each other have hereunto subscribed our names as witnesses - John Hutchinson - Geo Bull
