Full Will: |
THIS IS THE LAST WILL of me Philip Pratley of 67 Garmoyle Road Liverpool in the County of Lancaster Builder /1. I appoint my wife Emma Pratley Henry Langadale Wrathall of 223 Edge Lane in the City of Liverpool and Thomas Biddulph of Greenfield Terrace Liverpool Sweet Manufacturer (hereafter called "my trustees") to be the EXECUTORS AND TRUSTEES of this my will /2. I give to my wife Emma Pratley the sum of twenty five pounds (free of death duties) to be paid to her within three calendar months after my death
3. I give to the trustees for the time being of the Church of Christ Upper Parliament Street in the City of Liverpool the sum of fifty pounds (free of death duties) to be by those applied and disposed of in aid of the cause of religion in connection with the said Church as to the trustees thereof shall seem fit and I declare that the receipt of the treasurer or other proper officer for the time being of such church shall be a sufficient discharge of the same
4. I give the use and enjoyment of my dwellinghouse Number 67 Garmoyle Road in the City of Liverpool and of all my furniture plate plated goods linen glass china books and pictures and all other articles of domestic of household use or ornament belonging to me to my said wife during her life (free of death duties) she paying the rates taxes and outgoings for the time being payable in respect of the said dwellinghouse and keeping the same properly insured against fire and in good repair an also insured against fire and in good repair and also keeping the said furniture and other effects properly insured against fire And I declare that from and after the decease of my said wife the same shall fall into and form part of my residuary estate And I declare that it shall not be necessary to take an inventory of the said furniture and other effects and that my trustees shall not be concerned to see to the insurance of the said dwellinghouse furniture and other effects not be obliged to see to the preservation thereof which may happen during the lifetime of my said wife
5. I give all my property not hereby otherwise disposed of unto my trustees in trust to convert the same into money and to invest the proceeds (after paying my funeral and testamentary expenses) with power to vary the investments thereof and to pay the income thereof unto my said wife during her life if she shall so long remain my widow and from and after her decease or second marriage (which shall first happen) In trust for all my children who being sons attain the age of twenty one years or being daughters attain that age or marry in equal shares and if there shall be only one such child the whole to be in trust for the one child Provided always that if any child of mine shall die in my lifetime having a child or children who shall survive me and being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under that age then and in every such case the last mentioned child or children shall the (and in more than one equally between them) the share which his her or their parent would have taken of and in the proceeds if such parent had survived me attain the age of twenty one years
6. I empower my trustees to postpone the conversion of any part of my property for so long as they shall think fit and the income of my property remaining unconverted shall from the time of my decease be paid and applied in the same manner as the income of the proceeds thereof would have been payable and applicable for the time being if the same had been converted
IN WITNESS whereof I the said Philip Pratley have to this my will set me hand this twenty third day of August 1900 - PHILIP PRALTEY - Signed by the said testator as his last will in the presence of us present at the same time in his presence and at his request and in the presence of each other have hereto set our names as witnesses - C.H. BURTON Solr Liverpool - T. JACKSON His clerk.
On the seventeenth day of March 1921 Probate of this will was granted to Emma Pratley one of the executors |
