WITNEY.
COUNTY COURT.
The bi-monthly sitting of this Court took place on Tuesday last. The business included one adjournment, six committment summonses, and 54 original plaints. The following came before His Honour Judge Snagge.-
claim under the tithe act.
Ecclesiastical Commissioners v. Charles Pratley, White Oak Green, Hailey, nurseryman. This was a claim of £1 9s. 1d. and £1 13s. 2d. These actions were taken under the Tithe Act of 1891 for the recovery of a rent charge in the first case, and the defendant being sued as the owner occupying the land, and in the second as owner of land let to a tenant. Applications were now made for Orders under the Tithe Act to destrain on the land in the first case, and to appoint a receiver of rents in the second case.
No one appeared on either side, and the Judge appointed the Bailiff of the Court (Mr. Andrews) as receiver in one case, and distrainer in the other case. |

| Full Will: |
I CHARLES PRATLEY of White Oak Bury Street Lo-wer[sic] Edmonton in the County of Middlesex hereby revoke all prior wills and testamentary dispositions and declare this to be my last will
1. I appoint my wife Ellen Amy Pratley Samuel South Junior of the Potteries White Hart Lane Tottenham Potmaker and my son in law Frank Chaplin of White Oak aforesaid (hereinafter called "my Trustees") to be the EXECUTORS and TRUSTEES of my will and I give to the said Samuel South Junior and Frank Chaplin Twenty pounds each free of duty for their trouble in acting as such Executors and Trustees
2. I give to my wife a legacy of One hundred pounds free of duty for her immediate requirements to be paid within three months of my deceased I also give to her all consumable household stores and all my watches jewels trinkets and wearing apparel absolutely
3. I bequeath to my wife the use and enjoyment of all my furniture plate plated articles linen china glass books and all other articles of domestic or household use during her life my Trustees keeping the same insured against fire and during War against Aircraft and after her death the same shall fall into my residuary estate and I declare that my Trustees shall not be concerned during the lifetime of my wife to see to the preservation of the said furniture and effects or any of them or be liable for any loss or damage which may happen thereto and I declare that my wife may at any time with the consent in writing of my Trustees ell any part of the said effects and apply the proceeds in the purchase of other effects of a like nature to be held upon the same trusts
4. I give to my daughter Edith Chaplin eight hundred pounds to be paid on the death of my wife I also give to each of my grandchildren then living Five pounds and to Nellie French of Ware if then living Thirty pounds and I direct that in each such the legacy shall be paid free of duty
5. I bequeath my leasehold house White Oak Lower Edmonton aforesaid to my Trustees upon trust either to pay the net rents and profits thereof to my wife during her life or to permit her to receive the same to occupy the said dwellinghouse during her life my Trustees keeping the same in repair and insured against fire and during War against Aircraft and on the death of my Wife I bequeath the said dwellinghouse to my daughter Edith Chaplin absolutely
6. I devise and bequeath all my estate and effects not hereby otherwise disposed of including any property or money over which I may have any power of appointment or disposition by will but not including my copyhold estates unto my Trustees Upon trust that my Trustees shall with the consent of my wife (subject to the provisions hereinafter contained with respect to my businesses hereinafter mentioned) sell call in and convert into money the same or such parts thereof as shall not consist of money and shall out of the moneys produced by such sale calling in and conversion and out or my ready money pay my funeral and testamentary expenses and debts and the legacies payable on my death bequeathed by my will or any Codicil hereto and the duty on any legacies hereinbefore given free of duty and shall invest the residue of the said moneys with power from time to time with the consent in writing of my wife to vary the investments and shall stand possessed of the residue of the said moneys and the investments for the time being representing the same Upon trust to pay the income thereof to my wife during her life and after her death In trust to pay the pecuniary legacies payable on her death and to stand possessed of the net residue in trust for all my children living at my death (except the said Charles Henry Pratley and Edith Chaplin) and if more than on in equal shares
7. Provided always that if any child of mine shall have died in my lifetime leaving a child or children living at my death who being a son or sons attain the age of twenty one years or being a daughter or daughters attain that age or marry under that age then and in every such case the last mentioned child or children shall take and if more than one equally between them the property and/ or legacy and/ or share which his her or their parent would have taken if such parent had survived me and attained a vested interest my Trustees shall have all requisite powers of sale for the purpose of effecting any necessary division

With respect to my farming wood and timber and nursery businesses now carried on by me or any other business which I may be engaged at my death I empower my Trustees to continue the same for so long as they may think fir and to discontinue the same at any time and to wind up the affairs thereof with liberty for my Trustees if and so long as they shall continue the businesses to employ therein the whole or any part of the capital which shall be employed therein at my death and also such further part (if any) of my estate as they shall think fit and with power to pay compensation to outgoing tenants and to employ bailiffs labourers workmen agents and clerks and to employ any existing live and dead stock and buy or sell live or dead stock and generally to act in the conduct of the said businesses as they shall in their absolute discretion think fit and as if they were beneficially entitled thereto without being answerable for any loss arising thereby I direct that the consent of my wife to the sale of any of my businesses shall not be required unless she shall at the time of such sale be a Trustee of my will in which case her consent as a Trustee only shall be required in the usual way my intention being that her consent in her capacity as tenant for life shall not be necessary
9. I authorise my Trustees to postpone the sale and conversion of my residuary estate or any part thereof for so long as they shall think fir and I declare that the rents profits and income of my property (whether consisting of investments of any authorised character or not including leaseholds or other property of a terminable or wearing out nature) for the time being remaining unsold and unconverted including the profits of the said businesses while carried on by my Trustees shall be paid and applied from my death as if the same were income arising from the investments of the proceeds of such sale calling in and conversion no part thereof being liable to be retained as capital
10. I declare that as regards my real or leasehold property my Trustees may manage let or demise the same either from year to year or for any term of years at such rent and subject to such covenants and conditions as they shall think fit and may accept surrenders of leases and tenancies cut timber expend money in repairs and improvements and generally manage the property according to their absolute discretion and I direct that the proceeds of any timber sold be my Trustees shall be considered as income and that any money required for repairs or improvements may be raised either out of income or out of the capital of my estate as my Trustees shall under the circumstances think fair and equitable
11. I will that my copyhold estates shall be disposed of according to the trusts hereinbefore contained concerning my residuary estate and I devise my copyhold estates to such uses as my Trustees shall by any deed or deeds to be executed within twenty one years of my death appoint in order to complete any sale or sales to be made pursuant to my will and in default of appointment to the use of my Trustees to be hold by them upon and subject to the trusts declared in relation to my said residuary estate
12. I declare that the statutory power of appointing new Trustees shall for the purposes of this my will be vested in my wife during her life and that the expression "my Trustees" used in this my will shall include the Trustees or Trustee for the time being hereof
